The “No Court” Commitment
In the Collaborative Family Law process each of you has your own
specially trained lawyer. You, your partner and both lawyers work as
a team to resolve issues in a series of round table 4-way meetings
(two of you plus two lawyers). We all sign an agreement at the
beginning that we will not go to Court. If one of you later changes
your mind about this, both of you have to hire new lawyers. This
helps to ensure we all remain focused on constructively resolving
the issues and threatening phrases like “see you in Court” lose all
meaning. In our experience this feature of the agreement is very
powerful and encourages imaginative problem-solving.
Resolution in real-time
Your lawyers are by your side throughout the process to manage the
discussions in a constructive, non-confrontational way. All
discussions take place face to face so there is little room for
misunderstanding. Your lawyers aim to build trust between you and
are trained to help you overcome communication difficulties so you
can focus on finding solutions. Both of you are fully involved in
discussions.

Tailor-made solutions for your family
No two families are the same, and Collaborative Family Law enables
you to focus on issues that are important to your family, and find a
solution that works for all of you. You are both in control of the
outcome; you are not handing your future over to a court to make
decisions for you.
Your lawyers will advise and guide you about the law in the
meetings. You will both hear the same information at the same time.
Your lawyers work together in a very different way from traditional
lawyers preparing for a court hearing. They talk constructively
about your respective needs and how to find creative solutions to
your particular problems.
Meetings usually last for 1-2 hours, and typically there could be
between 2 and 4 meetings. Much depends on how complex your case is.
Meetings are arranged at a pace you can both cope with, and in
response to issues that arise along the way.
Funding your case
Legal Aid is not yet available for Collaborative Family Law.
However, we can discuss other funding options such as meeting your
costs from joint assets or incomes.
