Bryony advising the BBC
Our Immigration Partner Bryony was asked by the BBC to comment on this undercover investigation and particularly the conduct of the Solicitor involved.
Civil Penalties are substantial statutory fines that can be imposed on employers who have illegal workers. They can lead to court proceedings and can have significant implications for businesses that face them. All Solicitors in the UK must comply with a code of conduct and uphold the standards of professionalism expected of them by our regulatory body and the public. Core standards include not to mislead the court or bodies such as the Home Office, not to generate false evidence and to only act on instructions from a client
Suggesting a client puts forward false information to seek to avoid a civil penalty risks them facing very serious additional sanctions and undermines the law and trust in our profession. Any business that receives a Civil Penalty and seeks advice should be able to approach a Solicitor with confidence that they will obtain advice on the options available to them within the law.
