Court of Protection

We have protected the interests of vulnerable people, in the North East for over 35 years. The Court of Protection will make decisions for people who do not have the mental capacity to make them for themselves.

Usually, a deputy (often a family member) will manage the person’s property, financial affairs or health and personal issues.  If someone you care about hasn’t the capacity to make important decisions, our experienced solicitors in Newcastle or South Shields can advise and assist you.

Our solicitors can represent concerned family members when there are issues concerning a relative’s health and welfare and a decision is needed from the Court of Protection.  This could include issues such as where the relative should live and with whom or whether they should receive a particular treatment.

We can also act on behalf of the Official Solicitor (appointed by the court to represent the incapacitated person’s best interests) in Court of Protection proceedings. When appointed by the Court of Protection we can act as a professional deputy to manage the affairs of the incapacitated person.

Our Court of Protection team can also assist family members or lay deputies in managing others financial affairs.  Our team offers support and guidance on the management of finances when an individual has lost or is losing capacity and is unable to progress urgent interim applications to the court.  The team make home visits when required.
