What is a clean break?
A clean break is a type of financial order that can be obtained by divorcing spouses to dismiss any future claims either party may make against the other. A clean break order severs all financial ties between you and your ex-partner and ensures a final settlement of assets, pensions, and other property.
This type of order brings an end to all remaining financial claims between you, meaning neither party can pursue further applications in the future. As a clean break order does not include spousal maintenance, it allows both parties to move forward with complete financial independence.
Even if you reach an agreement between yourselves, a clean break must be approved by the court to become legally binding.
When is a clean break order appropriate?
A clean break is most suitable where both individuals can meet their own needs post-separation without relying on ongoing financial support from the other. This may be the case where:
- Both parties have similar earning capacities
- Each person is in stable employment
