A Civil Penalty is served by the Home Office when a business employs staff who do not have the right to work in the UK or whose visa limits the type or amount of work they can do. The amount of penalties was increased in February 2024 to a starting point of £45,000 per illegal worker or £60,000 for a repeat infringement. Employers who knowingly flout the law can also be subject to prosecution.
The investigation focussed on businesses facing Civil Penalties who attempted to gain legitimate advice but instead were advised to provide false information to seek to avoid the fines.
