Smart Motorway Speed Camera Error: Thousands of Drivers Wrongly Fined
A nationwide fault in smart motorway speed cameras has led to thousands of motorists being wrongly fined for speeding across the UK. A software error affecting HADECS 3 variable speed cameras meant cameras were enforcing outdated speed limits, even when gantry signs showed a higher lawful limit.
The problem, which dates back to January 2021, created a delay between variable speed limit signs and speed camera enforcement. As a result, drivers complying with the displayed limit were still recorded as speeding. More than 36,000 cases have already been cancelled, with police forces withdrawing prosecutions, refunds being issued, and penalty points removed.
Motorists affected may include those who:
- paid speeding fines,
- accepted penalty points,
- attended speed awareness courses, or
- were convicted in court
- even disqualified from driving
If you received a smart motorway speeding ticket or variable speed limit offence since January 2021, particularly on motorways or major A-roads, you may be entitled to a refund, and points or disqualification removed.
The police should be contacting motorists directly but you may be unaware if you have changed address, particularly if DVLA have not yet been updated.
What about smart motorways in the North East?
The North East has limited smart motorway coverage. The only confirmed smart motorway in the region is the A1(M) between Dishforth and Barton, which operates variable speed limits enforced by cameras. However, many North East motorists regularly travel on smart motorways elsewhere in England for work or leisure. Importantly, the camera fault applies nationwide, so drivers from Newcastle and the wider North East may be affected even if the offence did not occur locally.
