Road Traffic Act 1988 Section 2
Dangerous driving is where driving falls far below the standard expected of a reasonable driver and is considered dangerous.
Under Section 2 of the Road Traffic Act 1988, the official UK legislation defines dangerous driving as:
“A person who drives a mechanically propelled vehicle dangerously on a road or other public place is guilty of an offence”
Examples of dangerous driving offences include driving at a grossly excessive speed, overtaking in an unsafe situation and racing. It is important to note that dangerous driving is different from careless driving, where the prosecution must only provide the driving was below the standard of a reasonable driver.
Dangerous driving disqualification
Dangerous driving normally carries a mandatory disqualification of at least 12 months and a requirement to sit an extended re-test. The Court will also consider imposing a fine of up to £10,000 and has the power to give a custodial sentence of up to two years.
