Section 172 of Road Traffic Act 1988

Failure to identify the driver of a vehicle when required to do so is an offence for which you can receive a minimum of 6 penalty points or even face disqualification from driving. This offence is part of Section 172 of the Road Traffic Act and comes about when the registered keeper of a vehicle or any other person does not provide details of who was driving at the time of an offence. Failure to comply with the regulations for Section 172 of the Road Traffic Act could lead to prosecution in court.

Responding to a “failure to identify driver” Notice

If you or your company or business has received a Notice of Intended Prosecution (NIP), you are required by law to respond within 28 days to inform the police  of who was driving the vehicle at the time of the alleged motoring offence.

Failure to identify driver – totting up and exceptional hardship

As a result of the Totting Up system, if you receive 12 or more penalty points within three years, you should be immediately disqualified from driving for six months. The period of the ban after a motoring offence will increase if you have been disqualified from driving before.  However, you can avoid disqualification if you prove you would suffer “exceptional hardship”. To be successful, you must prove to the court that the consequences would be exceptional and more than hardship or inconvenience.  Some examples of exceptional hardship which could prevent you from being disqualified after a motoring offence include mortgage or financial loss and caring for others.
